Census or sample? Assessing the utility = of=20 Indigenous population change data, 2001 to 2006

Abstract: Population counts represent = the key=20 output from each national census as they establish the base = from=20 which population estimates are subsequently derived and the = levels=20 at which population characteristics are established. Such=20 information is vital in assessing change over time in social = indicators and plays a key role in the assessment of policy = impacts.=20 A notable feature of successive Indigenous census counts has = been=20 their volatility and unpredictability with numbers = invariably=20 greater each time than change due to natural increase alone = would=20 suggest. Indigenous population change recorded over the most = recent=20 inter-censal period (2001-2006) provides no exception.=20
While the picture at the national level has been well = researched,=20 it is at the local level where programs are delivered and = the need=20 for accurate data is greatest. However, there has been = little=20 attempt to assess the robustness of population change data = at this=20 level. This presentation examines the spatial pattern of = change in=20 census counts and assesses these against a range of likely=20 predictors. We find that for some areas the Census provides=20 reasonable estimates, whereas for others the Census is more = akin to=20 a sample survey with implications for analysis, = interpretation and=20 policy utility.

A half hearted defence of the CDEP = scheme=20

=97Boyd Hunter (Fellow, CAEPR)

Abstract: The CDEP scheme was developed = as a=20 response to the perceived social threat of sit-down money to = Indigenous communities in the 1970s. Ironically, the scheme = is now=20 being criticised as being one of the main factors driving = the social=20 effects of prolonged welfare dependence. This paper updates = the=20 Office of Evaluation and Audit 1997 Report that evaluates = the=20 scheme. While this paper shows that the CDEP scheme has a=20 significant effect of reducing social pathologies, = vis-=E0-vis=20 unemployment, the positive effect of the scheme is = substantially=20 less than the protective effect of having mainstream = (non-CDEP)=20 scheme employment. Consequently, it is the lack of = mainstream=20 employment options, rather than the presence of the CDEP = scheme that=20 drives the social pathologies identified in recent public = debate.=20 Notwithstanding the evident community development associated = with=20 the CDEP scheme, it cannot be the whole answer for = disadvantaged=20 Indigenous communities, which also need a mixture of = economic=20 development, infrastructure spending and bottom-up policy=20 initiatives.

Regional change in the Indigenous = population:=20 Early results from the 2006 Census

Abstract: The new Federal Government has = identified as one of its priorities a 'closing of the gaps' = in=20 social and economic outcomes between Indigenous and = non-Indigenous=20 Australians with specific reference made to health/life = expectancy,=20 education participation and attainment, housing and = employment.=20 Previous CAEPR research has shown that the structural = circumstances=20 facing Indigenous populations are increasingly diverse and=20 locationally dispersed and that this leads to variable = constraints=20 and opportunities for social and economic participation. In = light of=20 the renewed emphasis on targets in Indigenous public policy = there is=20 a need to update this spatial analysis and explore the = extent to=20 which prospects for the achievement of parity continue to be = influenced by location.=20
As part of a new research project at CAEPR sponsored by = the=20 Ministerial Council on Aboriginal and Torres Strait Islander = Affairs=20 (MCATSIA) and aimed at maximising the use of = recently-available 2006=20 Census data, this paper presents the preliminary findings of = a=20 regional analysis of recent change in Indigenous population = and=20 social indicators between 2001 and 2006. In doing so, three=20 interrelated questions are addressed. First, how does the = scale and=20 nature of gaps in key social indicators vary spatially? = Second, how=20 do trends in these vary in an absolute and relative sense? = Finally,=20 given the methodological issues involved, how meaningful are = measures of relative outcomes at a regional or national = level and is=20 it possible to accurately assess changes through time in = these=20 outcomes?

Good governance and indigenous peoples: = What's=20 western law got to say about it?

=97Laura Beacroft (ANU Law School and Office of the = Registrar of=20 Aboriginal and Torres Strait Islander Corporations)

Abstract: Laura Beacroft held an = independent=20 statutory position with the Australian government for the = last 5=20 years, regulating many key Indigenous corporations, = including those=20 connected to native title and also most of those in remote=20 Australia. She shepherded in comprehensive and modern = legislation=20 for this sector (Corporations (Aboriginal and Torres = Strait=20 Islander) Act 2006, which received tripartite support = from=20 Parliament and is being progressively implemented around = Australia.=20 She is a lawyer, and has spent many years working in the = courts, and=20 on 'big picture' solutions to key systemic issues in the = justice=20 system. She is a co-author of Indigenous Legal = Issues, a=20 widely used textbook, and is currently at the Law College = ANU=20 writing her contribution to the next edition of this book. =

Potemkin in Cape York: The Politics of=20 Misrepresentation in Aurukun's Welfare Reform Trials =

=97Philip Martin (Doctoral Scholar, School of Philosophy, = Anthropology & Social Inquiry, University of Melbourne) =

Abstract: The community engagement = strategy for=20 the Cape York Welfare Reform trials was designed to = represent=20 communities and individuals under consultation strictly in = terms of=20 seven pre-determined 'community dysfunctions' only. They = were: the=20 abuse and neglect of children; alcohol abuse; drug abuse; = petrol=20 sniffing; problem gambling; poor school attendance; and=20 dysfunctional housing tenancy arrangements. However, much of = the=20 research conducted on the ground in Aurukun suggests = community=20 members do not define themselves or their immediate families = in=20 terms of 'social-norms deficit'. Where individuals have = identified=20 community problems, they are often not the same ones = suggested by=20 Cape York Institute (CYI). Despite this, the instrumental = goals and=20 design of the Welfare Reform community engagement strategy = meant=20 that if someone in Aurukun said they were worried about = violence=20 between clans=97which they often did=97their comments would = be rendered=20 in CYI's evaluation as further evidence of 'Alcohol Abuse' = or 'Child=20 Neglect'. In this way the seven core community dysfunctions = were=20 continually re-discovered=97thereby substantiating the need = for the=20 Families Responsibilities Commissions.=20
By focusing primarily on community dysfunctions and = individuals'=20 deficits identified independently from community members, = and=20 imposing welfare and behavioral obligations which tie = Aboriginal=20 people to services they already know to be oftentimes = inadequate and=20 inappropriate, Pearson's Family Responsibilities Commissions = (FRCs)=20 threaten to add yet another complicating factor to the = bizarre daily=20 spectacle of law and order in communities. Under the CYI = model,=20 various state and non-state actors will be tasked not with = assessing=20 the dynamic service needs of the individuals they are sent, = but with=20 administering ongoing punitive social intervention. This = means that=20 over the course of an FRC intervention, the quality and = relevance of=20 the support and intervention services are less important = than the=20 regularity of individuals' attendance at their appointments. = The=20 complexity of the individual's addiction, dysfunction or = problem=20 will be concealed by the straight-forwardness of the=20 'service-solution'. It thus seems probable that by forcing = community=20 members to perform a pantomime of reform to an audience of=20 historically ineffectual community service providers, FRCs = will=20 further diminish individuals' abilities to self-determine = positive=20 outcomes for themselves and their families while at the same = time=20 rendering them in ways which justify the FRCs (in the first = place).=20

Buying the hotel: Social value or social = liability=20 for Indigenous groups? Some preliminary thoughts =

Abstract: At the core of alcohol control = policies in Australia=97and indeed in any country with a = system of=20 licensing=97lies a key conflict. This is the conflict = between the=20 interest of the state in reducing alcohol-related problems = on the=20 one hand, and its interest in enjoying the economic benefits = produced by the alcohol beverage industry on the other. When = an=20 Indigenous corporation buys into premises licensed to sell = alcohol,=20 it is faced with a similar conflict and a moral hazard: good = sales=20 may mean more alcohol-related harms for which others largely = bear=20 the cost. This paper presents some preliminary thoughts on a = new=20 project examining the challenges for Indigenous enterprises = that=20 profit from the sale of alcohol.

Voting with their feet: Population study = in the=20 Ngaanyatjarra region

Abstract: Analysts of Australian Bureau = of=20 Statistics (ABS) census data have commonly observed that the = census=20 enumeration in remote Indigenous regions of Australia = underestimates=20 the actual number of Indigenous people. Such = underestimations of=20 remote population groups have dire consequences not only for = appropriate service delivery in such extreme regions, but = also=20 contribute to a misguided public perception that the = population in=20 remote Indigenous regions is declining. Clearly a better = approach to=20 undertaking census counts is needed in remote Australia. In = this=20 seminar David Brooks and Inge Kral will discuss a case study = population survey in the Ngaanyatjarra Lands region of = Western=20 Australia undertaken in response to concerns that the = official ABS=20 2006 census count in the area was lower than expected. = Brooks and=20 Kral will outline the anthropological methodology used to = survey the=20 population and ultimately attain a more accurate count. = Factors=20 accounting for Ngaanyatjarra spatial location including = mobility and=20 connectedness to country will also be analysed and = discussed. The=20 seminar will be introduced by Robin Smythe, Chairman of the=20 Ngaanyatjarra Council and Visiting Indigenous Fellow at = CAEPR.

Caring for Country: An overview of = Aboriginal land=20 management in the Top End of the Northern Territory =

=97Sean Kerins (Research Fellow, CAEPR)

Abstract: Aboriginal People in the = tropical=20 savannah of the Northern Territory (NT) own 170,000km2 of = land=20 including 85% of the coastline. Land and sea country have = great=20 cultural, economic and social significance to Aboriginal = people,=20 underpinning their culture and society. Aboriginal = landowners=20 continue to be reliant on the natural environment for both = spiritual=20 and physical well-being. Creation ancestors form part of a = living=20 landscape and practices such as hunting, foraging, burning, = caring=20 for sacred sites and ceremony have an important place in=20 contemporary Aboriginal life. These practices ensure the = maintenance=20 of spiritual, cultural and economic connections to land and = sea.=20
From a scientific perspective these lands are some of the = most=20 biologically diverse and intact in the Northern Territory = (and=20 Australia). They support important biological values = including=20 nationally and internationally significant wetlands, = migratory=20 seabird and shorebird habitats and marine turtle nesting = sites, rare=20 and threatened species and endemic species. Many of these = values are=20 either very poorly represented or not represented at all in = the=20 Northern Territory's park system. Of the 23 bioregions = represented=20 in the Northern Territory, about one third occur = predominantly on=20 Aboriginal land.=20
Owning and managing lands of such significance brings = with it=20 many diverse challenges. In the mid 1990s, to better meet = these=20 challenges, Aboriginal traditional landowners in the = tropical=20 savannah of the NT began to formalise their land and sea = management=20 activities through the establishment of the Caring for = Country=20 programme or what are commonly referred to as ranger groups. =
To date the Caring for Country programme has grown to = include=20 over 36 groups with up to 400 Aboriginal people employed in = land and=20 sea management. This seminar provides an overview of the = Caring for=20 Country Programme and examines how and why it works, as well = as,=20 what some of the challenges are that the programme faces. =

Living through a National Emergency: A = view of the=20 Intervention from Ground Zero

Abstract: This seminar will provide a=20 perspective on the Intervention from one of the largest = Indigenous=20 townships in the NT through the eyes of two doctoral = research=20 scholars who were researching in the community as the = Intervention=20 broke. The paper analyses the initial reactions of both the = people=20 of the region and their local organisations, as well as = detailing=20 their interactions with the Northern Territory Emergency = Response=20 Taskforce and other government agencies during the first = month of=20 the Intervention. In so doing, we posit the local experience = of the=20 Intervention as a transformative and traumatic moment in the = township=92s relationship with state and explore a deeper = question=20 around the nature of the intervention and its bearing upon = the=20 concept of state and local engagement in the = post-Intervention=20 period.

A comparative analysis of the influence = of think=20 tanks on indigenous policy in Australia and the USA =

=97Nicole Watson (Research Fellow, Jumbunna Indigenous = House of=20 Learning, UTS)

Abstract: One of the defining = characteristics of=20 Indigenous policy during the Howard era was the emerging = influence=20 of conservative think tanks, and in particular, the Centre = for=20 Independent Studies (CIS) and the Cape York Institute for = Policy and=20 Leadership (CYIPL). While this development mirrors other = policy=20 settings, there are some unique features of the ideologies = espoused=20 by CIS and CYIPL. Both appear to have a religious quest to = transform=20 Indigenous societies. I use the term 'religious' because so = much of=20 what they advocate rests on faith as opposed to evidence, = both use=20 apocalyptic language to describe Indigenous communities and = promise=20 salvation for those who embrace their faith. It is within = this quest=20 that the beliefs that shaped Native American law and policy = in the=20 nineteenth century find resonance and in particular, the = maxim that=20 individual property rights are critical for the salvation of = Indigenous people. Reforms to encourage the growth of = individual=20 property rights did not occur in isolation, but were = implemented=20 contemporaneously with measures to transform the social = fabric.

Challenges for sustainable governance in = the=20 development and implementation of comprehensive mining = agreements=20

=97David Martin (Visiting Fellow, CAEPR)

Abstract: Agreement making, especially = through=20 Indigenous Land Use Agreements, is an increasingly important = aspect=20 of native title practice. Major mining agreements in = particular are=20 typically highly complex legally-driven documents which = focus on=20 meeting or reconciling the various parties' perceived = aspirations=20 and interests within a risk management framework. However,=20 comparatively little attention is given to agreements' = necessarily=20 intercultural character, and their roles in social and = cultural as=20 well as economic transformation. This seminar will focus on = three=20 key arenas which, it is argued, are crucial in both the = design and=20 implementation of sustainable agreements. Firstly, it argues = that=20 inadequate attention is paid to the governance of agreements = as=20 systems. Secondly, it outlines key implications of = agreements being=20 'intercultural' institutions. Lastly, it proposes that the = objective=20 reality of ongoing Aboriginal socio-cultural transformation = must be=20 factored into both the design and implementation phases of=20 agreements.

The politics of 'the gap' in Australia = and New=20 Zealand

Abstract: This paper is part of a longer = project=20 about the history of Indigenous population statistics in = Australia,=20 Canada and New Zealand. In the contemporary use of official=20 statistics by Indigenous and non-Indigenous policy = intellectuals, a=20 particular understanding of social justice has emerged. = Public=20 discussion highlights the population binary=20 'Indigenous/non-Indigenous' and finds unjust the 'gap' = between=20 Indigenous and non-Indigenous values of certain = socio-economic=20 variables. I will answer two questions:
(1) How did we = get the=20 binary that we now use? I will identify moments in the = recent past=20 in which there has been debate about where the boundary = (defining=20 the Indigenous/non-Indigenous binary) should be placed. =
(2) What=20 is the relationship between evoking the 'Indigenous people' = (a=20 politico-juridical entity) and quantifying the 'Indigenous=20 population' (a socio-demographic entity)? Indigenous = advocacy in=20 Australia and New Zealand does both, but there is a tension = between=20 these two ideas. I will argue that our research and advocacy = should=20 draw on the data about 'Indigenous population' to give more=20 consideration of the differences among the 'Indigenous = people', in=20 order to develop a more complex theory of social justice. =

Literacy and remote Indigenous youth: = Why social=20 practice matters

Abstract: Writing about literacy in the = remote=20 Aboriginal context rarely considers anthropological aspects = such as=20 whether literacy has been incorporated into social practice, = and how=20 we understand change, transmission and transformation in the = evolving social practices and cultural conceptions of = reading and=20 writing across the generations in the remote world. In this = seminar=20 Jerry Schwab and Inge Kral suggest that, in addition to = schooling,=20 everyday social practice is critical to literacy = acquisition,=20 maintenance and development in remote contexts. Attention = will be=20 drawn to the social generational differences and changing = modes of=20 literacy from mission era alphabetic literacy practices to = the=20 digital literacy practices of youth today. The seminar will = focus on=20 the important role that youth-oriented organisations and = programs=20 have to play in supporting access to literacy resources and=20 stimulating learning that is attractive to youth in remote = contexts=20 where school attendance and retention rates are poor.

'Development' in Indigenous Australia:=20 international meanings and local approaches

Abstract: There is growing recognition = that a=20 'development' approach to Indigenous communities could be = useful, in=20 contrast to (or to complement) a service delivery approach = to=20 Indigenous Affairs. But what does a development approach = mean? There=20 are many different ideas about what 'development' is and how = it is=20 achieved, and hence many different approaches to = 'development'. This=20 seminar will canvass some approaches to 'development' common = in the=20 international arena and critically explore how they are = being=20 articulated in Indigenous Australia, explicitly or = implicitly.

Abstract: The recent passing away of a=20 significant number of senior Aboriginal artists has raised = concern=20 about the future of Aboriginal art. This, together with = reports of a=20 market flooded with second-rate work and a lingering anxiety = that=20 the popularity of Aboriginal art may have run its course = animates my=20 research on the inter-generational shift in the production = and=20 market for Aboriginal art.=20
This seminar discusses the recent Senate inquiry into the = Indigenous visual arts and craft sector and examines what = progress,=20 if any, has been made since the Senate released its report = in June=20 2007. Providing the most recent overview of the sector, the=20 recommendations of the Senate's report Indigenous Art - = Securing=20 the Future will be compared with those of previous = reports in=20 an attempt to determine the effectiveness of such inquiries = on=20 government policy and initiatives.
